Terms & Conditions of Service

1. Eligibility, Account Registration & Security

• Age Eligibility: You must be at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872, to make purchases on SolBombay.
• Account Creation: You agree to provide accurate, complete, and current information when creating an account or placing an order. SolBombay provides seamless auto-account creation on your first checkout to preserve your order history and delivery addresses.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@solbombay.com of any unauthorized access.

2. Online Orders, Pricing, Taxes & Invoicing

• Currency & Pricing: All prices displayed across SolBombay are in Indian National Rupees (INR / ₹) and inclusive of all applicable statutory Goods & Services Tax (GST) unless explicitly indicated otherwise.
• Order Acceptance: Placement of an order represents an offer to purchase. An order is formally accepted and binding only when payment is verified by our gateway and an official SolBombay Order Confirmation Invoice (bearing an SB-XXXXXX reference ID) is issued.
• Price Integrity & Corrections: In the rare event of a technical typographical error resulting in a mispriced item, SolBombay reserves the right to cancel the affected order and issue an immediate 100% full refund before kitchen preparation commences.
• Tax Invoices: Official A4 GST-compliant tax invoices are automatically generated upon payment and remain accessible in your My Account portal.

3. Payment Methods & Gateway Security (Razorpay)

SolBombay integrates with Razorpay, an RBI-licensed Payment Aggregator certified to PCI-DSS Level 1 compliance. Supported payment methods include:

• UPI: Google Pay, PhonePe, Paytm, BHIM, and all bank UPI apps.
• Debit & Credit Cards: Visa, MasterCard, RuPay, American Express, and international payment cards.
• Net Banking: Major scheduled commercial banks in India.

SolBombay never stores, processes, or captures your raw credit/debit card numbers, CVVs, or Net Banking credentials on our web infrastructure.

4. Perishable Goods, Hand Delivery & Time Slot Logistics

Because Haute Pâtisserie cakes, delicate macarons, and multi-layered chocolate entremets are fragile, perishable food creations, our delivery operations are governed by the following terms:

• Delivery Coverage: White-glove express delivery is available across Mumbai, Navi Mumbai, and Thane zones.
• Scheduled 1-Hour Time Slots: Customers select a preferred delivery date and 1-hour time slot during checkout. While we maintain a 98%+ on-time record, unexpected urban traffic or severe monsoon weather conditions may occasionally cause slight delays.
• Recipient Availability: The recipient must be present at the provided delivery address during the chosen delivery window. Because perishable baked goods require refrigeration (4°C - 8°C), packages cannot be left unattended outside residences.
• Unsuccessful Delivery: If our delivery concierge cannot gain access or reach the recipient after 15 minutes of holding on-site, the order will be returned to the kitchen. Re-delivery attempts may incur an additional delivery fee.

5. Bespoke 3D Sculpted Cakes & Atelier Commissions

• Design Consultation: Custom 3D sculpted cakes, royal multi-tiered wedding centerpieces, and corporate gala commissions require interactive consultation via our dedicated WhatsApp concierge bridge (+91 9769633976).
• Artistic Discretion: While our master chefs strive to match reference imagery precisely, handcrafted edible sculptures are individual artistic creations; minor artistic variations in hand-painted gold luster, edible sculpting paste shades, and organic flower placements may occur.
• Lead Times: Complex multi-tiered wedding cakes require a minimum lead time of 48 to 72 hours for structural curing and ingredient sourcing.

6. Masterclass Video Streaming & Recipe Ratio Card License

• Prohibited Actions: You may NOT record, rip, screen-capture, redistribute, resell, broadcast, upload to third-party platforms (e.g. YouTube, Vimeo, Telegram, Google Drive), or commercially exploit SolBombay masterclass videos or secret recipe ratio cards.
• Violation Consequences: Any unauthorized sharing, pirating, or commercial duplication of SolBombay proprietary educational material will result in immediate account termination without refund and legal prosecution under the Indian Copyright Act, 1957.

7. Spin & Win Promotional Campaign & In-Store 2FA Rules

• Participation Limit: Participation in the SolBombay Spin & Win promotion is strictly limited to one (1) spin per participant / device / IP address per 24-hour cycle. Bypassing limits using automated scripts, VPN rotation, or multiple disposable emails will result in immediate reward forfeiture.
• OTP Verification: To spin and claim a prize, participants must verify their identity via a valid 10-digit mobile number, email, and 4-digit OTP.
• 7-Day In-Store Redemption: Winning vouchers (e.g. Complimentary Macaron Box, Artisanal Cake Discounts) must be redeemed in person at an official SolBombay boutique showroom within 7 calendar days from the win date.
• In-Store 2FA Verification: Static screenshot images are not valid proof of winning. At the boutique counter, the manager will trigger a live 4-digit Claim Verification Code sent to your registered email address. The reward is issued exclusively upon providing this live verification code.
• No Cash Value: Promotional prizes carry zero cash surrender value and cannot be exchanged for cash.

8. Food Safety, Ingredients & Allergen Disclaimers (FSSAI)

• 100% Eggless Preparations: We offer dedicated 100% Eggless recipes prepared with separate utensils and protocols. However, customers with severe, life-threatening airborne allergies must notify our concierge prior to ordering.
• Edible 24K Gold: Our luxury cakes feature certified food-grade edible 24K gold leaf complying with international culinary safety standards.
• Storage Instructions: Perishable entremets and cakes must be refrigerated immediately upon receipt and consumed within 48 to 72 hours for peak freshness.

9. Intellectual Property & Copyright Notice

All content on SolBombay — including but not limited to brand names, logos, 3D cake design blueprints, recipe formulations, ratio cards, pastry photography, videos, graphics, audio, and custom code — is the exclusive intellectual property of SolBombay Haute Pâtisserie and protected under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and international copyright treaties.

No content from this website may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any manner without prior explicit written authorization from Maison SolBombay.

10. Limitation of Liability & Force Majeure

• To the fullest extent permitted by applicable Indian law, SolBombay's total aggregate liability arising out of any order, transaction, or website use shall be strictly limited to the net amount actually paid by you for the specific product or service giving rise to the claim.
• SolBombay shall not be held liable for any indirect, consequential, punitive, or incidental damages, including missed event celebrations resulting from unexpected delivery delays caused by Force Majeure events.
• Force Majeure: SolBombay is not liable for failures or delays in performance resulting from causes beyond reasonable control, including natural disasters, extreme monsoon flooding, civic disruptions, riots, power grid failures, or government-mandated lockdowns.

11. Indemnification

You agree to indemnify, defend, and hold harmless SolBombay, its founders, chefs, staff, and affiliates from and against any third-party claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, unauthorized commercial redistribution of masterclasses, or violation of any applicable law.

12. Governing Law, Dispute Resolution & Jurisdiction

These Terms shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles.
